By downloading, accessing, or using the Padel Rating mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the App.
We may revise these Terms at any time by updating this page. By using this App after such changes are posted, you agree to the revised Terms.
By using our App, you represent and warrant that you meet all eligibility requirements we outline in these Terms. We may still refuse to let certain people access or use the App. We may also change our eligibility criteria at any time.
To use certain features of the App, you must register for an account. When you register, you agree to provide accurate, current, and complete information about yourself and to update this information to maintain its accuracy. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate your account if any information provided during the registration process or thereafter proves to be inaccurate, false, or misleading, or if you violate any provision of these Terms.
Our App allows users to purchase and use tokens for various services at participating clubs. By purchasing tokens, you agree to pay all fees and applicable taxes incurred by you or anyone using your account. We reserve the right to change our pricing at any time.
All purchases are final and non-refundable, except as required by law or at our sole discretion. If you believe you have been charged in error, please contact us immediately.
Some features of our App may require a subscription. Subscriptions automatically renew until canceled by you. You can cancel your subscription at any time through your account settings or by contacting us directly.
Subscription fees are billed in advance on a recurring basis, depending on the subscription plan you select. You authorize us to charge your payment method for the subscription fees and any applicable taxes.
Our App may allow you to post, link, store, share, or otherwise provide content, including personal information, comments, and feedback ("User Content"). You retain ownership rights in your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with the App.
You represent and warrant that your User Content does not violate any third-party rights, including intellectual property rights and privacy rights, and complies with all applicable laws and regulations.
You agree not to engage in any of the following prohibited activities:
The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by us, our licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
These Terms permit you to use the App for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER WE NOR ANY PERSON ASSOCIATED WITH US MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE APP.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE, OUR AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE APP, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
You agree to defend, indemnify, and hold us harmless from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.
We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.
